T the confirmation hearings for our new chief justice, like all such hearings in recent years, were controlled by a ridiculous premise that almost nobody questions. the premise is that it is not possible for a judge to state his views on a legal question in the hearings and then have an open mind when that same legal question comes before him in a trial after he's been confirmed. it amounts to saying that it's impossible to publicly take a position and subsequently change one's mind. this proposition strikes me as being an obvious absurdity, but, since everybody seems to be going along with it, perhaps it will be a public service to point out some of the valid reasons that exist for changing one's mind, whether or not the workings of said mind are a matter of public record. sometimes we change our minds simply because we reconsider the information we based our first conclusion on. a good example of this would be a math problem involving lots of computations. we might get one answer, then review our calculations and find we've made a mistake. we correct our mistake and get a new answer. we've changed our minds without new information. why couldn't a judge do that? sometimes we change our minds because we become aware of new facts. consider the example of the state governor who was pro capital punishment until dna testing showed that several of the inmates on his death row couldn't have committed the crimes they were there for. he changed his position based on new information. why couldn't a judge do that? sometimes we change our minds because we hear new arguments. imagine someone being against gay marriage because he doesn't agree with the 14th amendment's equal protection argument that's frequently made in favor of it. but then he hears a first amendment argument saying that laws against gay marriage violate the establishment clause by preferring the practices of religions that won't marry gay people to the practices of religions that do. he might say, "i still don't buy the 14th amendment argument for gay marriage, but i'm convinced that this new first amendment argument is valid." why couldn't a judge do that? in sum, everybody who's not a lunatic changes positions on any number of issues all the time, and changes them for very good and quite sufficient reasons. judge roberts, the subject of the recent confirmation hearings, said that a litigant before him in a future case has a right to an open-minded judge. he didn't deny having opinions, so apparently having opinions doesn't keep a judge from being open-minded. evidently it's the stating of those opinions for the public record that supposedly closes a judge's mind. if that's the case, and if a litigant deserves an open-minded judge, doesn't if follow that one of the qualifications for a judgeship should be the prospective judge's renunciation of his own first amendment right of free speech? is this not the height of the ridiculous? open-mindedness in a judge is the same as open-mindedness in anyone else. it does not consist in being free of opinions. it does not consist of never having stated an opinion. it is instead a willingness to rethink your positions, plus a willingness to consider new information, plus a willingness to consider new arguments. open-mindedness is an act of will, not the absence of a paper trail. judge roberts kept pointing out that other candidates for judgeships had taken the same anti-candor position with the senate that he was taking. one wonders how the senators react to their children when they say, "all the other kids are doing it." lots of senators are lawyers, or were trained as lawyers. they're supposed to be smart. yet they buy or pretend to buy this absurd anti-candor argument and then spend all their time dancing around the margins of the real issues they're supposed to be addressing. instead of saying, "the openmindedness crap won't wash, " they're essentially saying, "you're right, but couldn't you at least show us a little leg?" what's more frightening? a ; the senators really are that dumb. b ; they don't mind looking that dumb? By paul cohen, ncas '66 labor day weekend. september 5th was a beautiful, sunny day at usc's mcalister field for a soccer game and a postgame tailgate party. let's begin with the tailgate party that rcsc hosted for the players, coaches, parents, and club members. for some of the players, it was their first reception hosted by an alumni club. there were approximately 20 parents, traveling from new jersey, who attended the game. head coach glenn cooks gave a brief talk in which he applauded the club, and presented me with an autographed jersey. did i forget the game? not really, it was exciting and competitive, but ru led by all american carli lloyd, lost in overtime, 3-2. also, i have to report that ru lost to lmu on friday. it was still a memorable and enjoyable day.
